Formal Criminal Charges Being Filed against Mark Andrew Austin, Thailand-based Internet Operator. Austin Vows to Hurt the 'Island He Loves.'

PT Bali Discovery Tours, the owners and operators of balidiscovery.com, have issued formal instructions to their attorneys to file multiple criminal complaints against Mr. Mark Andrew Austin, a citizen of the U.K. and owner of Bali and Thailand Hotels, Ltd and several Internet travel sites.

The charges against Mr. Austin are being handled by Mr. Suryatin Lijaya, S.H., a recognized leader in civil and criminal law practicing before the Denpasar Courts. While the specific details of the various criminal charges will remain sealed and with the police until Mr. Austin personally presents himself to the police for further investigation, among the complaints Mr. Austin is being asked to answer concerns various untrue and defamatory statements published on Internet sites under Mr. Austin's ownership and control against Bali Discovery Tours and its President Director, J.M. Daniels.

Via widely circulated e-mails and statements published on his websites, Mr. Austin has accused Bali Discovery Tours and Mr. Daniels of filing a false police report against him with the Indonesian Police resulting in his "detention" and interrogation in December of 2002. Bali Discovery Tours and its President Director have adamantly denied these accusations, insisting no proof exists to substantiate Mr. Austin's allegations.

Efforts to mediate the matter by Bali Discovery Tours' attorney asking that the offending material be removed from the Internet have been unsuccessful, prompting the latest legal step against Mr. Austin.

Meanwhile, Mr. Mark Austin briefly published a threat "to hurt the island he loves" on his travel forum on June 5, pledging to take steps to make sure material detrimental to Bali tourism appear "whenever people search for 'bali hotels', 'bali tours', 'bali', etc.." Apologizing in advance to his "friends in Bali," Austin, describing Mr. Daniels and anyone who supports him as "cancer," justified such actions by saying "sometimes it is better to cut the cancer out, no matter how painful it is for the patient."

Commenting on the decision to proceed with a criminal complaint against Mark Austin, Bali Discovery Tours' President Director, J.M. Daniels, said the criminal complaint "will represent the saddest, final irony in the angry crusade of Mr. Austin against Bali Discovery Tours: the very people he has incorrectly accused of filing police reports against him late last year will be the very people who finally bring him before the law for his criminal acts in Indonesia."
