The provincial enforcement team for Bali has delivered the second written waning to the Beach World Project within the Nusa Dua Complex.
The letter, addressed to the I Made Putera, the director of PT Bali Sunrise Beach, ordered work to cease on the Beach World water park, bar, restaurant and spa facility being constructed on Lot C-O of the Bali Tourism Development Corporation Complex (BTDC) because the project violates zoning laws demanding a minimum set back of 100 meters from the high-water mark. The Beach World Club Project stands only 45 meters from the water's edge.
The head of the provinces enforcement team, I Gede Putu Jaya Suartama, cited the developer's "bad faith" in continuing to construct the project despite receiving their first "cease and desist" order one month ago.
Suartama said the purpose of the warning process was to minimize material and social displacement by halting a project clearly in violation of the 2009 Zoning Law (RTRW).
Promising to intensify scrutiny of the project site, Suartama threatened stronger action against the project and the developer if work continues. "If construction continues, don't blame us if the project developers and the owners suffer even greater material losses," he warned.
Typically a third warning is issued 30 days after the second warning has been delivered. Following a third and final warning enforcement officials can then take the further steps of sealing the project and, in some circumstance, even undertake the demolishing of the offending structure.
The Beach World Complex is seen by many observers as a key test case in the governors 2009 Zoning law that will clarify if the island's provincial administrators are able to successfully impose their view of good spatial planning on the regencies and metropolitans areas of Bali.
