Bali Environmental Group Serves Legal Notice on Governor and Four State-Owned Companies Building Islandís First Toll Way

Friends of the Earth-Bali (WALHI) has sent a formal legal notice to Bali’s governor Made Mangku Pastika in connection with the construction of the elevated toll road connection Benoa – Ngurah Rai Airport – Nusa Dua.

Beritabali.com reports that a formal legal notice (“Somasi”) was sent by WALHI to the governor because, in the opinion of the environmental group, Made Mangku Pastika has failed to take remedial action against the four state-owned enterprises building the highway in a manner that violates the environmental impact plan for the project.

The Bali chairman of WALHI, Gendo Suardana, told the press on Wednesday, October 17, 2012, that his organization’s demand that the Governor to temporarily halt the road project went unheeded. Such a halt to construction, according to WALHI, is in accordance with regulations on protecting the environment and completely within Pastika’s legal authority.

“The Governor has the authority to first give warnings, second stop activities if those activities threaten the environment, and three even seize equipment,” Gendo explained. Adding, “the governor has this authority and this has become an image for the public that our governor has never been serious about handling violations happening before his very eyes.”

Gendo Suardana added that WALHI is also serving formal legal notice to "cease and desist" on the road project to the four state-owned enterprises forming the consortium to build and operate Bali’s first toll road: PT. Jasa Marga, PT. Pengembang Pariwisata Bali, PT. Angkasa Pura and PT. Pelindo.
