Bali's Skyline: The Height of Stupidity

Debate Continues on What, if Anything, Can be Done to Those Who Violate Height Restrictions in Bali.

(11/24/2008) NusaBali reports that despite the great fuss made by local legislators inspecting buildings violating Bali's 15 meter height restriction, officials charged with actually enforcing building codes and zoning rules are content to point fingers at each other when asked "why isn't something being done to bring errant buildings into line?".

Dinas Cipta Karya (DCK) - the zoning authority for Badung, insist that while they are monitoring violations the issue of actual enforcement is left to the "judicial team."DCK told the press that they have identified a number of building height violations, including a villa condominium in Kedonganan and the Anantara Resort, and issued formal written reprimands dating from September 2008.

The Chief of DCK office for Badung, I Ketut Suwandi, said: "We have issued warnings, so please don't say we're staying silent. But for further action, well that's the judicial team's job. What's clear both buildings are in violation of local regulations. We have issued warnings twice."

Suwandi said that both buildings have clearly broken the Zoning Law of 2007 citing a maximum height allowance of 15 meters. The only building exempted from this restriction are radio towers, airport towers, buildings used for defense purposes, religious buildings, lighthouses and monuments.

Suwandi said that the penalty for these violations is the revocation of the building permit (IMB), admitting that his office has yet to take this remedial step. A revocation of the two buildings' IMB would, in principle, put the two accommodation providers out of business, making their buildings unfit/illegal for habitation.

In addition to the revocation of the building permits, the current law also provides for fines of Rp. 50 million (US$4,200) and up to 6 months in jail.

In response to criticism printed in the local press that the provincial government offices also violate the height restriction, Suwandi responded, saying that government buildings join the list of permissible exemptions from the 15 meter height limitation. In any case, his survey of the government buildings determined that they fall within the 15 meter limit.

An inspection visit to the Anantara Resort conducted by members of Commission III of the Provincial House of Representatives (DPRD) concluded that the Anantara Resort in Seminyak was in violation of its building permit with the structure standing 17 meters, 2 meters more its building plan height of 15 meters.

Another project cited for violating local building height rules is the Panorama Hill Condominium in South Kuta which is 19.6 meters high.
