Casting Suspicions on Bali's Bupatis

Local Legislators Thinks Bali's Regents are Behind Legal Challenge to Bali's New Zoning Law.

(10/23/2010) Beritabali.com confirms that the Bali House of Representatives (DPRD-Bali) is writing to the Indonesian Supreme court asking that the judges reject the ongoing judicial review of Bali's Zoning Laws (RTRW) placed before the courts by several Balinese investors. The move, in support of the new zoning law, reflects the DPRD's commitment to retain the RTRW which has already been ratified by the Ministry of Internal Affairs.

The vice-chairman of Commission IV of the DPRD-Bali, Ketut Kariyasa Adnyana, told the press that the Bali zoning law is "final" and cannot be changed merely to suit the demands of investors. Adnyana expressed the suspicion that at least one regent (Bupati) is behind the challenge to the zoning law made in the name of investors. Supporting this suspicion, he pointed to how several regencies, such as Badung, Gianyar, Klungkung and Karangasem have deliberately played stalling tactics in introducing the RTRW which imposes island-wide zoning standards and demands prison penalties for regents who grant special exemptions to the rules at the behest of investors.

"I suspect that these bupatis are sponsoring efforts to change the RTRW," said Adnyana.

The vice-chairman of Commission IV said that one year after the introduction of the RTRW the regencies should be complying with the new rules. Instead, only Denpasar has managed to undertake revisions and compliance steps.
