Badung Regency Officials Threaten to Demolish Illegal Beach Structures On Geger and Jimbaran Beaches in Bali.

(7/17/2011) The Zoning Authority for Bali's regency of Badung is insisting that they will soon knock down a structure standing on Balangan Beach in Jimbaran, erected only 10 meters from the high-water mark. The regent of Badung, A.A. Gde Agung, has issued instructions for action to be taken against the half-completed structure that has been constructed in violation of the law and without benefit of any building permit.

The official spokesman of the Badung regency, I Wayan Weda Dharmaja, told NusaBali that the regent has ordered his subordinates to take the steps necessary in accordance with law in bringing the errant structure into compliance.

Regency rules passed in 1995 stipulate buildings can be no closer to the high-water mark than 25 meters. However, more stringent provincial zoning rules, introduced in 2007 and 2009, forbid permanent structures standing within 100 meters of the high-water mark.

Reacting to rumors circulating the local press that the illegal structure enjoyed special protection, Dharmaja said no “backing” from any official would protect the illegal building from the implementation of the law.

Meanwhile, the Chairman of "Commission A" of the Badung Regency House of Representatives  (DPRD-Badung), Nyoman Satria, said: “The sanction is clear; it must be demolished. Our Commission will support any steps to enforce the law taken by the Executive.”

The head of the Zoning Agency for Badung (Dinas Cipta Karya Badung) declared that his office has never issued a permit in connection with the building standing too close to the water’s edge.

The chief of the village of Jimbaran (Lurah) has also confirmed that his office has never granted any permit for the building.

Efforts by the press to identity the actual owner or builder of the illegal structure have proven fruitless.

In the midst of the controversy over the illegal structure on Jimbaran beach, another case has surfaced on Geger Beach in South Bali.

The Geger Beach property, which has been the object of complaints from local citizens, is reportedly owned by a property company located in Sanur. Like the offending property in Jimbaran, the Geger Beach property stands less than 10 meters from the high-water mark.

Vice-regent of the Badung regency, Ketut Sudikerta, vowed that the regency would take firm action against all building violating the zoning laws, adding, “if they are indeed breaking the law, tear them down.”

Sudikerta admitted that building standing too close to the water’s edge is a long-standing problem and his office is only able to move against new buildings being erected too close to the water line. Buildings that are already standing, he said, are difficult to bring into line as the legal process is complicated and compensation must be paid to the building owners. “Who will pay the compensation for buildings that must be demolished?” asked Sudikerta.

In a separate, but related, case the Beach World Complex at the Nusa Dua Complex is now in the final stages of construction standing only 45 meters from the high water mark. Actively opposed by local residents who claim the building bars access to the public right-of-way for the adjoining beach, regency officials have granted a permit to the building under regional rules allowing construction more than 25 meters from the shore. Meanwhile, the much stricter provincial rule require construction of all building to be set back a minimum 100 meters. Provincial authorities, lead by the Governor, claim the Beach World Complex is illegal and that provincial rules supersede any regional regulations.
