Being Duly Diligent with the Governorís Decree

Indonesian Ombudsmen Office Reviewing Legality of Governorís Decree for Reclamation of Benoa Bay in Bali

(8/5/2013)

The Indonesian Ombudsman Office has announced that it is seeking a formal clarification in connection with a decree issued by Bali’s governor Made Mangku Pastika authorizing a large-scale reclamation project in Benoa Bay.

The head of the Indonesia Ombudsman Office in Bali, Umar Ibnu Alkhatab, quoted by Seputarbali.com said, “I will seek a clarification from the provincial government by reviewing the formal documents to determine if the process took place according to the rules or was wrongly administered.”

With Alkhatab’s announcement, the review of the decree issued by the Governor on December 26, 2012 granting permission to utilize, develop and manage Padang Bay has now formally become a part of the Ombudsman’s work plan for the second semester of 2013.

“I have seen that this topic has become a matter of widespread public attention and for that reason we are seeking an explanation form the government. While there has been no formal report to the Ombudsmen Office, we have the authority to take the initiative to investigate this,“ said Alkhatab.

At the same time, the Bali Ombudsman said it would be helpful if a public report or complaint were sent to his office seeking an official clarification of the Governor’s decree.

After the investigation, the Ombudsman’s office can certify the decree and its issuance conforms with the law or, alternatively. identify any procedural or legal shortcomings that might call the legality of the governor’s decree into question.
