Step Up Hotel on Bingin Beach, Bali:  Zoning & Building Code Violations.

Accused of violating minimal setback distance restrictions from the shoreline and zoning regulations, Bali Authorities are scrutinizing the Set Up Hotel on Bingin Beach in South Kuta, Bali.

RadarBali.com reports that flagrant violations of zoning rules in Badung Regency, Bali, are a continuing problem. Accordingly, Commission I of the Bali Provincial Legislative Assembly (DPRD) on Friday, 13 June 2025, scrutinized The Set Up Hotel – a new property located in Jimbaran, South Kuta, 

The official visit by legislators to the new hotel served as a follow-up to an earlier session at the DPRD held on Tuesday, 11 June 2025, during which lawmakers portrayed the hotel project as a ”bad example” of how unregulated new investment has encroached on coastal boundaries and violated applicable setback regulations.

Commission I is undertaking firm action against non-conforming buildings of the Island’s zoning rules located in the Bingin Beach area. As a result of the unannounced inspection visit, the legislators issued orders for the demolition of buildings found in violation of spatial planning regulations on Bingin Beach involving The Step Up Hotel.

I Made Suparta, a member of Commission I of the Bali Provincial DPRD, explained that his constituency will not compromise on licensing issues and violations of existing regulations. Buildings found in violation of the rules must be demolished and sanctioned under the law. Adding: “If hotels violate the law, this must be cleaned up. Officials involved must also be ready to be sanctioned according to applicable laws.” 

Meanwhile, Deputy Chairman of Commission I, Dewa Nyoman Rai, endorsed the Commission’s recommendations regarding needed changes in the physical construction of the Step Up Hotel, adding that the recommendations had been submitted to the local enforcement agency (Satpol-PP) to allow the demolition process to begin.

“Anyone proven to have violated our Regional Zoning and Spatial Planning Rules (RTRW) will immediately be ordered to demolish the offending structures,” warned Rai.

Rai expanded his warning, saying violations went beyond building projects of hotels and villas but also often included violations of agrarian laws, spatial planning stipulations, and presidential regulations addressing coastlines and riverways.

Somvir, another Member of Commission I, after reading the Bingin Beach recommendations, warned that officials who grant permits and violate the rules could be subject to up to 5 years in prison.

The team from the DPRD conducted an earlier field inspection on 7 May 2025, which found numerous violations involving buildings built on cliffs, coastal boundaries, and state land, and violations of rules regarding Bali’s Rules on Spatial Planning and Regional Development (RTRWP).

Somvir hammered home his point, firmly proclaiming: “This is not only a matter of spatial planning, but also maintaining public safety and the overall sustainability of the area. Following the vision of the Governor of Bali, Nangun Sat Kerthi Loka Bali, violations must be prosecuted to protect the future of Bali.”

A Step Up Hotel Project consultant, I Gusti Made Arya Kencana, has defended the hotel, insisting the owners, management, and developers had met and fulfilled all the regulatory and permit requirements. “We follow the applicable regulations so as not to violate the law,” he said.
